Welcome to The Sailing Hangar. These Terms of Service ("Terms") govern your use of thesailinghangar.com (the "Platform"), operated by Lorenzo Ciani, based in Italy ("we", "us", "our"). By creating an account or using the Platform, you agree to these Terms.

1. What The Sailing Hangar is

The Sailing Hangar is a classifieds marketplace that lets users list, browse, and contact each other about sailing-related boats, boat parts, apparel, and gear — with a focus on dinghies and small multihulls.

We are a listings and contact platform only. We do not buy, sell, own, inspect, certify, or take possession of any boat, part, or item listed on the Platform. We are not a party to any transaction between a buyer and a seller. Once a buyer and seller are in contact, the negotiation, payment, inspection, and transfer of any item are handled entirely and directly between them, outside the Platform.

2. Eligibility and accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate contact information, including a valid email address and phone number, which we use to verify your account.

Accounts may be created by:

  • Individuals, buying or selling on their own behalf
  • Clubs and class associations, listing on behalf of their organization or members
  • Dealers and brokers, listing commercial inventory

3. Listings

When you create a listing, you confirm that:

  • You own the item, or are authorized to sell it on the owner's behalf
  • The information you provide (description, condition, price, photos, class/category) is accurate and not misleading
  • The item is legal to sell and does not infringe any third party's rights

We reserve the right to remove any listing that violates these Terms, is inaccurate, or is reported by other users, at our discretion and without prior notice.

Prohibited listings include, without limitation: stolen goods, counterfeit items, items that cannot legally be sold or exported, and anything unrelated to sailing/boating gear.

4. Fees

Creating and publishing a standard listing is free. We offer optional featured/boosted placement for a fee, which increases a listing's visibility on the Platform for a defined period. Fees for featured placement, and any related refund terms, are shown at the time of purchase.

5. Messaging and conduct

The Platform provides in-app messaging so buyers and sellers can contact each other. You agree not to:

  • Use the Platform to harass, threaten, or defraud other users
  • Post false, misleading, or defamatory content
  • Attempt to circumvent the Platform's verification or moderation systems
  • Use the Platform for any purpose other than buying, selling, or discussing sailing-related gear

6. Reviews and reputation

After a sale is confirmed, both buyer and seller may leave a rating and review. Reviews must reflect genuine experiences and must not be defamatory, fraudulent, or posted in exchange for compensation. We may remove reviews that violate these Terms.

Sale history is based on sellers marking a listing as sold and buyer confirmation. Because we are not party to the underlying transaction, we cannot independently verify that a reported sale occurred as described.

7. No warranty on listed items

Items listed on the Platform are sold "as is" by the seller, not by us. We make no representations or warranties about the condition, safety, seaworthiness, legality, or accuracy of any listing. It is your responsibility as a buyer to inspect, verify, and satisfy yourself about any item before completing a purchase.

8. Disclaimer of warranties and limitation of liability

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, The Sailing Hangar is not liable for:

  • Any dispute, loss, or damage arising from a transaction between users
  • The accuracy, quality, safety, or legality of any listing
  • Any indirect, incidental, or consequential damages arising from your use of the Platform

Nothing in these Terms limits liability that cannot be excluded or limited under applicable law, including any liability for fraud or willful misconduct.

9. Intellectual property

You retain ownership of the content you upload (photos, descriptions, etc.), but grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as necessary to operate the Platform. The Sailing Hangar name, logo, and site design are our property and may not be used without permission.

10. Suspension and termination

We may suspend or terminate your account if you violate these Terms, provide false information, or engage in conduct that harms other users or the Platform. You may delete your account at any time.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or a notice on the Platform before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Italy, without regard to conflict-of-law principles, subject to any mandatory consumer-protection rights you may have under the laws of your country of residence if you are an EU consumer.
